Oregon Driver's License Suspensions

If you have been arrested for DUII in Oregon, you will likely be facing two possible driver's license suspensions. The first is an administrative suspension through the Oregon Department of Motor Vehicles (DMV) and will be based on either a Breath Test Refusal or a Breath Test Failure. The length of this administrative suspension is typically 90 days, but can also be 1 year or even 3 years. This administrative driver's license suspension is automatic unless you request, and prevail at, a DMV Implied Consent Hearing.

The second type of driver's license suspension that can be imposed is based on a conviction for the crime of DUII. Typically, someone who is eligible for Oregon's DUII Diversion Program will not have a conviction entered. However, drivers who are facing their second or third DUII conviction can be facing a 1 year suspension or even a lifetime revocation of their driving privileges.

For both types of suspensions, hardship permits are often available which will allow you to travel to and from work, or to and from drug/alcohol treatment. There is usually a waiting period to obtain a hardship permit and it will vary depending on your driving and criminal history.

Oregon driver's license suspensions can be complicated. If you want more specific information on what type or length of suspension that you may be facing, contact a DUII attorney/lawyer or the Oregon DMV.
