![]() DUII Companion ChargesThere are a number of different types of traffic violations in Oregon, and several that are commonly seen charged in conjunction with DUII. Some of the more common violations associated with DUII are: Violation of Speed Limit, Careless Driving, Violation Of Open Container Law, Driving While Suspended, and Refusal To Take A Breath Test. Violations in Oregon are punishable by a fine, but the court cannot impose probation, jail or prison time. However, multiple convictions for certain violations can carry collateral consequences such as increased insurance premiums, and the loss of driving privileges.Aside from violations, many Oregon District Attorney's have begun charging other crimes with DUII. The most common additional charges are Reckless Driving and Reckless Endangering. These charges are often added even when a DUII case does not involve an accident. Sometimes the charges are based on a high BAC reading or the presence of passengers in the vehicle. These charges are misdemeanors and can carry the same or worse penalties than DUII (i.e. jail, probation, fines, etc). These charges can also prevent drivers who would normally be eligible for DUII diversion from entering the diversion program. Other charges that may be added by the District Attorney when an accident is involved include "Hit and Run", felony "Hit and Run", and Criminal Mischief. |
